  1. OUR APPROACH

Royalty Rising exists to help creators understand, organise and protect the value of their work.

We respect the intellectual property rights of musicians, songwriters, composers, performers, producers, labels, publishers, visual artists and other creators.

We expect Royalty Rising users to respect those rights too.

  1. YOUR MUSIC REMAINS YOURS

Using Royalty Rising does not transfer ownership of your music to Royalty Rising.

You retain whatever copyright, master rights, publishing rights and other intellectual property rights you already hold in:

Songs.

Musical compositions.

Sound recordings.

Lyrics.

Artwork.

Music metadata.

Creative materials.

Other content you submit.

  1. PERMISSION NEEDED TO OPERATE THE SERVICE

When you submit material to Royalty Rising, you give us only the permission reasonably necessary to provide the service.

This may include permission to:

Store the material.

Process it.

Analyse it.

Organise it.

Display it to you.

Create information or reports from it.

Transmit it where necessary to provide a feature you requested.

Maintain secure backup copies.

This permission does not transfer ownership of the underlying music or intellectual property to Royalty Rising.

  1. COLLABORATIVE WORKS

Music frequently involves several rights holders.

A recording may involve songwriters, performers, producers, publishers, labels and other contributors.

Entering information into Royalty Rising does not override the rights of another contributor.

If you submit information relating to jointly owned or collaboratively created material, you are responsible for having the authority needed to provide that information.

  1. ROYALTY RISING DOES NOT DETERMINE OWNERSHIP

Royalty Rising may help organise evidence, metadata and rights information.

However, merely entering a person as the owner, writer, performer, producer or rights holder within Royalty Rising does not legally establish that person's ownership.

A Royalty Rising Song Object, report, database entry or analysis is not automatically legal proof of copyright ownership.

Where ownership is disputed, the matter may require contracts, documentation, professional advice, a dispute-resolution process or a decision by an appropriate authority or court.

  1. USER RESPONSIBILITY

You must not knowingly upload or submit material that infringes another person's intellectual property rights.

You must have the necessary ownership, licence, consent or other authority to submit material to Royalty Rising.

You must not knowingly:

Claim authorship of work you did not create.

Claim ownership of rights you do not hold.

Remove or falsify rights information.

Provide fraudulent music metadata.

Upload copyrighted material without appropriate authority.

Misrepresent another person's contribution to a work.

  1. ROYALTY RISING INTELLECTUAL PROPERTY

R-RISING TECHNOLOGIES LTD owns or licenses intellectual property used in Royalty Rising.

This can include:

The Royalty Rising name and branding.

Software.

Application interfaces.

Original website content.

Original educational material.

Database structures.

Graphics and designs.

Reports and report formats.

Proprietary methodologies.

Scoring systems.

Workflows.

Original technology and tools.

Other materials developed by or for Royalty Rising.

Nothing in your use of Royalty Rising transfers ownership of Royalty Rising intellectual property to you.

  1. USING YOUR OWN REPORTS

You may download, retain and use reports produced specifically for you or your music assets.

You may share them with people such as:

Collaborators.

Managers.

Labels.

Publishers.

Professional advisers.

Collecting societies.

Distributors.

Other relevant organisations.

Your ability to use your own report does not give you ownership of Royalty Rising's underlying software, methodology, database or proprietary systems.

  1. PROHIBITED COPYING

Unless permitted by law or authorised by us, you must not:

Copy substantial parts of Royalty Rising's proprietary database.

Republish substantial amounts of Royalty Rising content as your own.

Sell copies of Royalty Rising proprietary material.

Create a competing service by copying Royalty Rising proprietary systems or content.

Reverse engineer software except where the law expressly allows it.

Remove Royalty Rising copyright or ownership notices.

Falsely represent Royalty Rising material as your own.

  1. TRADE MARKS AND BRANDING

Royalty Rising names, logos, graphics and other branding may be protected by trade mark, copyright and other intellectual property rights.

You must not use Royalty Rising branding in a way that falsely suggests that:

You are Royalty Rising.

You are officially authorised by Royalty Rising.

Royalty Rising endorses your product or organisation.

A partnership exists when it does not.

  1. COPYRIGHT COMPLAINTS

If you believe material available through Royalty Rising infringes copyright or another intellectual property right, contact:

Please provide sufficient information for us to investigate.

This should normally include:

Your name and contact information.

Identification of the work you believe is protected.

Identification of the material you believe infringes your rights.

The location of the material where possible.

An explanation of your ownership or authority.

Any useful supporting documentation.

A description of the action you are asking Royalty Rising to consider.

  1. OUR RESPONSE TO COPYRIGHT COMPLAINTS

We will consider credible intellectual property complaints and may request additional information.

Depending on the circumstances, we may:

Contact the user responsible for the material.

Temporarily restrict access to disputed material.

Remove material.

Request evidence of ownership or authority.

Restore material if a complaint cannot be substantiated.

Restrict or terminate an account in serious cases.

Preserve relevant information where required for a dispute or legal obligation.

  1. COMPETING OWNERSHIP CLAIMS

Royalty Rising is not a court and cannot finally determine complex disputes between competing rights holders.

If two or more parties make credible conflicting ownership claims, we may restrict disputed material while the issue is being addressed.

We may ask the parties to provide appropriate evidence or resolve the matter through the relevant legal, professional or industry process.

  1. FALSE OR ABUSIVE COPYRIGHT CLAIMS

You must not knowingly submit a false copyright complaint in an attempt to remove another person's legitimate material or disrupt their account.

We may take action against accounts used to make deliberately fraudulent or abusive claims.

  1. REPEAT OR SERIOUS INFRINGEMENT

We may suspend or terminate accounts that are deliberately or repeatedly used to infringe intellectual property rights.

The appropriate response will depend on the circumstances and seriousness of the conduct.

  1. THIRD-PARTY CONTENT AND DATABASES

Royalty Rising may reference information from external music services, databases, rights organisations or other public or licensed sources.

Rights in third-party material remain with their respective owners.

Displaying or referencing third-party information does not mean Royalty Rising claims ownership of it.

  1. AI-GENERATED OR AI-ASSISTED OUTPUT

Royalty Rising may use artificial intelligence as part of some services.

Intellectual property law relating to AI-generated and AI-assisted material can depend on the facts, source material, jurisdiction and degree of human contribution.

Royalty Rising does not guarantee that an AI-generated output creates exclusive intellectual property rights for a user.

Users should obtain professional advice where ownership or commercial exploitation of a particular AI-generated work is important.

  1. CHANGES TO THIS POLICY

We may update this policy when Royalty Rising services, intellectual property practices or applicable law change.

The current version will be published on the Royalty Rising website together with its last updated date.
